Man denied job and compensation after sick leave con

A worker has lost his employment tribunal case in Innsbruck in the Austrian Tirol  after he was fired by a local council for going off sick and then being photographed working as a builder.

The worker who worked for the local council in Pollingen was fired, but took his employer to court demanding his job back and to be compensated for his loss of pay.

The court refused the fired workers claim after they heard that the man went off sick after getting a doctors note to say he had problems with his arm and should avoid heavy work. But he could do easier tasks. He was then signed off sick.

However, the mayor who was suspicious of the man's activity whilst off work sick hired a detective to monitor his activity.

The man was pictured carrying out heavy duty work on a building site whilst supposedly off sick.

When he returned to work he was then fired. The court ruled carrying out this work whilst off sick would have made his condition worse and increased his sick leave.

The court refused the man's request to get his job back and get compensation.

The man claimed he faced mobbing and bullying by the mayor.

The worker now plans to appeal.
